Below you will find our terms and conditions and our privacy policy.

1. Terms applying to all users of the Creative Education website.

Please read these Terms and Conditions of Use ('Terms') carefully before using www.creativeeducation.co.uk ('the Website').
In these Terms, 'we', 'us' and ‘Creative Education’ means :

By using this Website you agree to be bound by these Terms
Whilst we try to ensure that the Website does not contain any error, defect, malfunction or corruption, we do not accept responsibility for any damage to or loss of data on your computer system, network or server that results from the download or use of the Website or any materials made available via the Website (except for death or personal injury caused by our negligence).
Whilst we try to ensure that the website is accessible at all times there may be a need to have a period of ‘down time’ while updates are processed. We will endeavour that any ‘down time’ will be kept to a minimum.
You accept that you will not have a claim for breach of contract (either against us or any Creative Education colleague) or otherwise in respect of such period of unavailability. You also acknowledge that we cannot be held responsible for any delay or disruptions that are inherent in the operation of the Internet and the World Wide Web, including viruses.
We shall not be liable to you for any of the following types of loss or damage arising out of or in connection with your use of the Website or any or content and/or facilities provided via the Website :

  • any loss of profits, loss of earnings, loss of anticipated savings, goodwill or revenue;
  • any loss or corruption of data; or
  • any indirect or consequential loss.

The exclusions and limitations of liability contained in this section do not apply to :

  • any loss or damage resulting from death or personal injury caused by our negligence;
  • loss or damages arising from our fraudulent misrepresentation; or
  • any other losses which may not be excluded or limited by law.

Each provision of this Paragraph shall be construed separately as between you and us. If any part is held by a court to be unreasonable, inapplicable or unenforceable, then the other parts shall still apply.
If any provision of these Terms becomes void or otherwise unenforceable in whole or in part, the validity of the remainder of these Terms shall not be affected.
If either we or you fail to enforce, or delay in enforcing, any of our respective rights or remedies under these Terms, such failure or delay shall not operate as an agreement to waive that right or remedy, and shall not prevent us from exercising that right or remedy in the future.
These Terms are governed by and shall be construed in accordance with English law. Any dispute arising between us under or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the English courts.

2. Purpose of the Website

The purpose of the Website is to provide individuals and businesses with information on the range of courses, locations, products and other services offered by or via Creative Education including enrolment in England, Wales and Northern Ireland.
Please note that the courses advertised on this Website are provided by approved Creative Education.

3. Copyright

The materials on this Website are protected by our and by third party copyright and other intellectual property rights as described in the Creative Education copyright statement.

4. Third Party Links

We may provide links to third-party websites from time to time. This may include links to sites owned by associated companies of Creative Education. Any links (including without limitation any links posted by other users of the Website) are provided for your convenience only and are accessed at your own risk. We are not responsible in any way for the content of any third party website or for goods or services provided by the operators of such websites, and, unless otherwise stated are not responsible for and do not endorse or recommend any third party website or its availability or contents or any agreement or understanding you enter into with a third party through a third party website. If you choose to use any of the links provided, you should read the terms and conditions and privacy statement of the third party website. Creative Education does not accept any liability for any loss, damage, expense, costs or liability whatsoever incurred by you in respect of these third party websites.

5. Amendments to the Terms

We reserve the right to amend these Terms from time to time. When we make a change we will update this page of the Website. If we do so, the updated version will be effective as soon as it is uploaded on to this Website. We recommend that you visit this page each time you visit the Website to ensure that you are aware of and are complying with any changes that we have made to these Terms. If you continue to use the Website you will be deemed to have accepted those changes from the point at which these changes come into effect.

6. Terms of Sale

Payment
Course fees, including any additional transfer charges, are due in full prior to the course taking place. Arrangement for payment after the course date must be made prior to the course. Where such arrangements have been agreed all fees must then be paid within 28 days of the course taking place. In the event of late payment we reserve the right to not accept future course bookings and to cancel delegates’ course bookings from your institution. We also reserve the right to charge interest on outstanding invoices at the rate of 2% per calendar month.

Cancellation
All cancellations must be received in writing to courses@creativeeducation.co.uk. There will be no charge if you wish to change the details of a delegate on a course.

Transferring Courses
A delegate may transfer from one course to another by requesting such a transfer in writing to courses@creativeeducation.co.uk  at least 30 days prior to the original course taking place. A transfer fee of £60 plus VAT will be payable.

Cancellation of Courses and Changes to Content
Creative Education’s courses are constantly updated and improved and we reserve the right to alter any of the courses’ content without prior notice.  Creative Education Limited will make every effort to provide the services as specified, but, if for any reason beyond its control it fails to do so, neither Creative Education Limited nor its directors or employees shall be liable for any resulting loss or damage.  In such circumstances, delegates will be offered an alternative date, a credit note or a full refund.

Authorisation
By submitting a booking to us, by whatever means, you are acknowledging that you have received authorisation for this expenditure from the relevant person at your institution.

Legal interpretation
The materials, training and courses provided by Creative Education Limited cannot be relied upon for legal interpretation.  Neither Creative Education Limited nor its employees, trainers or consultants can accept responsibility for delegates’ actions, or those of other people reading the course notes or interpreting the training in litigation, or responsibility for any loss incurred as a result of relying on the training or the training notes. 

Discounts
Any discounts on Creative Education Limited courses are exclusive – they cannot be combined. Except for pre-agreed discounts, the higher discount will always be applied.  Where discounts are offered these must be requested at time of booking, and will not automatically be applied. In cases where a free gift is offered, this will be delivered to the chosen address following full payment and the delegate’s attendance on the course, and only when the relevant gift code is quoted at the time of booking.

Security Policy

Creative Education companies have appropriate measures in place to ensure that our users' Data is protected against unauthorised access or use, alteration, unlawful or accidental destruction and accidental loss. User Data may be transferred outside the Creative Education to data processors such as fulfilment houses but they will act only on our instructions to provide the services required.

Transfer of Data

The Internet is a global environment. Using the Internet to collect and process personal data necessarily involves the transmission of data on an international basis. Therefore, by browsing the Creative Education and communicating electronically with us you acknowledge and agree to our processing of personal data in this way. We do not intentionally collect any information on children under 14 years of age. We will undertake to delete any details of such users where a parent or guardian has notified us that any such details have been obtained.
