The short version
These terms explain what you agree to when you use our website and courses or buy from us: who we are, how memberships, trials, payment and cancelling work, what you can do with course materials and what we’re responsible for. Individuals can cancel any time before their next renewal, and pay nothing if they cancel during the free 14 days. School and organisation memberships are priced per year on a three-year agreement. Course materials are for your own learning and your organisation’s use, not for copying or selling on. The full terms below take priority over this summary.
1. Who we are
Creative Education Limited runs this website and Creative Education Learning, the learning platform at learn.creativeeducation.co.uk where our courses happen. In these terms, “we” and “us” means Creative Education Limited, and “you” means the person using the site or buying from us. If you buy for an organisation, “you” also means the organisation.
We’re registered in England and Wales, company number 04662664. Our registered office and main trading address is 49 Station Road, Polegate, East Sussex, BN26 6EA. Our VAT number is GB809753404.
To contact us, email [email protected] or call 020 8680 4077 (Monday to Friday, 8am to 4pm).
2. About these terms
By using our website or courses, you accept these terms. If you don’t agree to them, please don’t use the site.
These other documents also apply:
- our privacy policy and cookie policy, and the learning platform’s privacy notice
- our in-house training terms, if you book training for your staff
- the order confirmation we send when you buy. If it says something different from these terms, the order confirmation wins.
Some of these terms apply only to consumers, and some only to business customers. We say so where they do.
- A consumer is someone buying for themselves, wholly or mainly outside their trade, business, craft or profession.
- A business customer is a school, college, trust, local authority, charity, company or other organisation that buys a membership or takes a free trial. Business customers don’t have the same rights to cancel as consumers, and we limit what we pay business customers differently (section 15).
If you’d like advice on these terms, speak to a legal adviser or Citizens Advice.
3. Your account
To use our courses you need an account on Creative Education Learning. When you make one:
- give your real name and a current email address, and keep them up to date. We use the email address to contact you, so tell us if it changes.
- make sure what you tell us is true, accurate and not misleading
- keep your sign-in details to yourself. Don’t share them, and choose a password that’s hard to guess.
- tell us straight away at [email protected] if you think someone else knows your sign-in details. Change your password if you can, and we’ll block access for you if you can’t.
We may switch off a sign-in if we reasonably think it isn’t safe, or that these terms have been broken.
If your school or organisation gives you access, your access through it ends when you leave or when its membership ends. Your own record of the courses you’ve finished and your certificates stays with you.
You can delete your account at any time from your account page, or ask us to. We’ll delete your information except where the law, a contract or an audit means we have to keep it, as the platform’s privacy notice explains. Deleting an account doesn’t end a paid membership or agreement on its own: cancel that as set out below.
4. Memberships for individuals and parents
An individual or parent membership gives you every course in that membership, and a certificate for each course you finish. You can pay monthly or yearly. You can also buy a single course on its own, with 12 months to finish it. Prices are on our website and include VAT.
Free trial
- Your first membership starts with 14 days free.
- We take your card details when you start, and email you three days before your first payment.
- If you cancel during the 14 days, you keep access until the end of them and pay nothing.
Renewal and cancelling
- Your membership renews automatically at the end of each month or year, and we take the next payment from your card, until you cancel.
- You can cancel any time before your next renewal, from your account page in one click, or by contacting us.
- When you cancel, you keep access until the end of the month or year you’ve paid for, and we don’t take another payment. We don’t refund part of a month or year, except under your right to change your mind (section 5).
5. Your right to change your mind (consumers)
If you’re a consumer, you have 14 days from the day you sign up to change your mind.
- With a free trial, those 14 days are your trial. Cancel during them and you pay nothing.
- If you buy without a trial, for example a single course or a second membership, and you start using it during the 14 days, you’re asking us to give you access straight away. If you then change your mind within the 14 days, we refund what you paid, less a fair amount for the time you had access.
- To tell us, cancel from your account page, email [email protected] or call 020 8680 4077. You don’t have to give a reason.
- We refund you within 14 days of you telling us, to the card or account you paid with. We don’t charge for the refund.
If you’d prefer to use a form, you can send us this one by email or post:
- To: Creative Education Limited, 49 Station Road, Polegate, East Sussex, BN26 6EA, [email protected]
- I give notice that I cancel my contract for access to Creative Education’s courses.
- Date I signed up:
- My name:
- My address:
- My signature (only if you send this form on paper):
- Date:
6. Memberships for schools and organisations
These terms apply to business customers only.
Your agreement
- School and organisation memberships are priced per year. They run on a three-year agreement, invoiced once a year, so you’re signing up for the full three years.
- Your order confirmation sets out the start date, the length of the agreement, the number of learners and the price.
- The person who signs up confirms they have the authority to agree to these terms for the organisation, and to approve the spending.
Free trials for organisations
- An organisation’s free trial lasts for the time shown on our website, from the start date in its confirmation.
- We’ll remind you at least 7 days before it ends. To carry on after the trial, sign up for a membership.
Your learners
- The people you give access to must be your staff, workers, volunteers, agents or contractors.
- No more learners may use the membership than your order confirmation allows, unless we agree otherwise in writing.
- To add learners, tell us in writing. If we agree, we’ll confirm it and switch them on within 5 days, and you pay for them as set out in section 7.
- Make sure each learner keeps their sign-in details to themselves. If you find a learner’s sign-in has been given to someone who isn’t one of your learners, switch it off straight away.
- If we ask, send us a list of your current learners within 5 business days.
- With reasonable notice, at our own cost and no more than once a quarter, we or someone we appoint may check that the membership is being used as agreed. If it turns out you’ve underpaid, you pay the difference at the prices on our website within 10 business days.
Ending your agreement
- At the end of the three years, a school or college membership renews unless you give us at least 30 days’ notice in writing before the renewal date. For a trust, local authority or other group of schools, the notice is 90 days.
- If you end your membership before the end of the agreement, you still pay the fees for the rest of it.
- You can end it straight away if we seriously break these terms and don’t put it right within 14 days of you telling us in writing. We’ll then refund, from the date it ends, any fees you’ve paid in advance for the rest of the period.
We can suspend access or end your membership straight away, by telling you in writing, if:
- you seriously break these terms and, where it can be put right, don’t put it right within 7 days of us telling you in writing
- you don’t pay something you owe us on time
- you become insolvent, enter administration or liquidation, make an arrangement with your creditors or stop trading, or take steps towards any of these
- your financial position gets so much worse that, in our opinion, you may not be able to meet your obligations under these terms
7. Paying
- You pay the fees on the dates in your order confirmation. Individuals and parents pay by card. Schools and organisations pay by invoice, once a year, unless we agree otherwise.
- Prices for individuals and parents include VAT. Prices for schools and organisations, and for training, are shown without VAT, which we add at the current rate.
- Business customers must pay in full, without holding back or setting off any amount, except tax the law requires to be deducted.
- If a payment is late, we can charge interest at 4% a year above the Bank of England base rate (or 4% a year while the base rate is below zero), from the date it was due until it’s paid, and we can switch off access until it’s paid. If a card payment fails, you still owe it, and we’ll agree another way for you to pay.
- We may change our prices on each yearly anniversary of your start date. We’ll tell you at least a month before. If you don’t want to carry on at the new price, contact us to end your membership before the change, and we’ll refund anything you’ve paid in advance for access you won’t get.
- We take care to show the right prices. If we find a mistake in the price of something you’ve ordered, and the right price is lower, we’ll charge the lower price. If it’s higher, we’ll contact you and you can pay the right price or cancel. If we can’t reach you, we’ll treat the order as cancelled and tell you in writing. If the mistake was obvious and we accepted your payment anyway, we may cancel and refund what you paid.
- We can refuse any payment we think is fraudulent or suspicious.
8. Using the courses and materials
We own, or have a licence to use, everything on our website and learning platform: the courses, videos, workbooks, downloads, webinars, podcasts and the rest. All rights are reserved.
You may:
- use the courses and materials for your own learning, and, if you’re a business customer, for your organisation’s own training
- print or download extracts of pages for your own use
- point colleagues at your organisation to content on the platform
You must not:
- copy, record, share, publish, sell, rent or otherwise make money from any course, video or material, or any part of the site, except as these terms allow
- change printed or downloaded copies, or use pictures, video, audio or graphics separately from the words that go with them
- give anyone else rights to our materials
Always credit us, and anyone named as an author, as the source of our content. Follow any instructions we give about how a particular resource may be used.
If you copy or share our materials in a way these terms don’t allow, your right to use the site stops straight away, and you must return or destroy the copies you’ve made. We may also take back the right to use particular materials at any time; if we do, stop using them and delete them.
Courses are updated from time to time. It’s up to you to use the latest version. We’re not responsible if you rely on content that has since been replaced.
9. Certificates
When you finish a course on the platform, you get a certificate. It shows the course, the date you finished, the CPD hours and when the course is due for renewal.
Each certificate has a link and a code anyone can use to check it’s genuine. Whoever checks it sees your name, the course and the dates.
Your certificates stay in your record for as long as you have an account. If you delete your account, a check still confirms the certificate was issued and is valid, but without your name.
10. Using the site fairly
Don’t use our website or platform:
- to break any law or regulation, or for anything unlawful or fraudulent
- to harm, or try to harm, children in any way
- to bully, insult, intimidate or humiliate anyone
- to send advertising or spam
- to upload or pass on viruses or anything else harmful, or any terrorist content
Don’t access without permission, interfere with, damage or disrupt the site, the platform, the systems they run on, or anyone else’s systems used to provide them. Don’t install anything that copies, changes or records our data, and tell us if you find that our data has been copied in this way. If you find you can reach parts of a system you shouldn’t, tell us and don’t share it.
Attacking the site, including with a denial-of-service attack, or deliberately introducing viruses or other harmful material, is a criminal offence under the Computer Misuse Act 1990. We’ll report it to the police, give them your identity, and your right to use the site will stop straight away.
No scraping or data mining
You must not use bots, scrapers or any other automated tool to access, copy, monitor or republish any part of the site or the platform, or run automated analysis of their text and data. We expressly reserve these rights, except where the law says we can’t.
Linking to us
You may link to any page on our website from a website you own, as long as you do it fairly and legally and don’t harm our reputation or take advantage of it. Don’t suggest we’re associated with you or endorse you when we’re not. The site you link from must meet the standards in section 11. We can withdraw this permission at any time. For any other use of our content, ask us first.
Other websites
Where we link to other websites, it’s for your information only. We don’t control them and aren’t responsible for them, and a link isn’t an endorsement.
Viruses
We don’t promise the site is free of bugs or viruses. Please use your own virus protection.
11. What you add
Some parts of the platform let you write or upload things, such as reflections, comments and evidence of training. Whatever you add must be accurate where it states facts, honestly held where it gives opinions, and lawful. It must not:
- be defamatory, obscene, offensive, hateful or threatening
- bully, harass, intimidate, upset or invade anyone’s privacy
- promote violence, discrimination, sexually explicit material, terrorism or any illegal activity
- include child sexual abuse material
- infringe anyone’s copyright, database right or trade mark, or break a duty of confidence
- pretend to be someone else, or to come from us
- advertise anything, or link to other sites
You keep ownership of what you add. You give us a licence to store, copy and use it to provide our services. We may publish comments made after a course on our course pages, but without your name or your school. If you’re a business customer, you’re responsible for any loss we suffer because something you or your learners added breaks these rules.
We can remove anything that doesn’t meet these standards. We can also give your identity to someone who claims that something you added breaks their intellectual property or privacy rights. Keep your own copy of anything important you add.
12. Changes to the site and courses
- We update and change the site and courses from time to time, and may remove content. We’ll try to give you reasonable notice of any major change.
- We may suspend, restrict or withdraw all or part of the site for business or operational reasons. We’ll try to give you reasonable notice. If we suspend the courses for more than 30 days in a row, we’ll refund you for the time you’ve paid for but couldn’t use.
- We may block access to the site, for one person or for an organisation, if you break these terms or the law.
13. What happens when access ends
When a membership ends, any rights either of us had built up until then stay in place, and so do the parts of these terms that are meant to carry on, such as those about our materials and our responsibility to you. Return or destroy any of our materials you haven’t paid for.
14. Our responsibility to you
We provide the site and courses with reasonable skill and care.
Nothing in these terms limits our responsibility where it would be unlawful to, including for death or personal injury caused by our negligence, or for fraud.
If you’re a consumer
We’re responsible for loss you suffer that’s caused by us breaking these terms, unless:
- it wasn’t foreseeable: it wasn’t obvious it would happen, and nothing you told us before you started meant we should have expected it
- it was caused by an event outside our control (section 16)
- it relates to using the courses for your trade, business or profession
If faulty digital content we’ve supplied damages your device or other digital content, and that’s because we didn’t use reasonable care and skill, we’ll repair the damage or pay you compensation. We’re not responsible for damage you could have avoided by applying a free update we offered, or by having the system requirements we told you about.
15. Our responsibility to business customers
This section applies to business customers only.
- Except as these terms say, we exclude all warranties and conditions implied by law, as far as the law allows.
- We’re not responsible for loss of profits, sales, business, contracts or expected savings, loss or corruption of software or data, damage to goodwill, or any indirect or consequential loss.
- Our total responsibility to you in each year of your membership, for all claims arising in that year, is limited to the fees you paid in that year if the agreement is less than a year old, or in the year before. A claim arises when the first event that leads to it happens. A claim that arises after the agreement ends counts as arising on its last day.
- You’re responsible for sending information to us securely.
- Nothing here limits what you owe us.
16. Events outside our control
If something outside our reasonable control, such as a pandemic or a failure of utilities, delays or stops access to the courses, we’ll tell you as soon as we can and do what we can to limit the effect. We won’t be in breach of these terms while it lasts, and won’t have to pay compensation for the delay.
- Consumers: if the delay is likely to be long, you can contact us to end your membership and get a refund for access you’ve paid for in advance but not received, less reasonable costs we’ve already had.
- Business customers: our obligations are paused for as long as the event lasts. If it lasts more than 60 days, you can cancel by contacting us.
17. Privacy and confidentiality
We use your personal information as our privacy policy and the platform’s privacy notice describe. If you give us personal information about anyone else, for example when you add staff to your organisation’s membership, you must have the right to do so. You and your organisation must follow data protection law when using the platform.
We’ll send you service emails about your account, your courses and changes to the platform.
Neither of us will share the other’s confidential information about its business, customers or suppliers, except with our own staff, advisers and subcontractors who need it to carry out this agreement and who keep it confidential, or where the law, a court or a regulator requires it.
18. Complaints and reporting content
If you’re unhappy with anything we’ve done, please tell us at [email protected] or on 020 8680 4077, and we’ll try to put it right.
If you see anything on the site or platform that could be connected to child sexual abuse or exploitation, or to terrorism, tell us straight away at [email protected]. Use the same address to complain about any other content, or about something of yours we’ve taken down.
19. Other legal points
- Notices: “in writing” includes email. A notice is received when it’s handed over, at 9am on the third working day after posting by first class post, or at 9am on the next working day after it’s emailed. This doesn’t apply to legal proceedings.
- Transferring these terms: we may transfer these terms to another organisation that will provide the courses. We’ll tell you in writing. If you’re a consumer, it won’t affect your rights, and you can end your membership within 14 days of us telling you and get a refund for access you’ve paid for in advance but not received.
- Whole agreement (business customers): these terms and your order confirmation are the whole agreement between us. You can’t rely on anything we said that isn’t in them, unless it was fraudulent.
- If part of these terms is invalid: the rest still applies.
- Other people: these terms are between you and us. Nobody else can enforce them.
20. Which laws apply
These terms are governed by the law of England and Wales.
- Consumers: wherever you live, you can bring a claim against us in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in the courts where you live. We can bring a claim against you in the courts of the country you live in.
- Business customers: the courts of England and Wales alone can settle any dispute or claim about these terms, including claims that aren’t about the contract.
21. Changes to these terms
We change these terms from time to time, and the date below shows when they last changed. Please check them each time you use the site, so you know which terms apply.
